Pennsylvania law provides for a program known as “probation without a verdict” for first time offenders of the Controlled Substance Act. Counties in Pennsylvania, such as Montgomery County, offer this program to first-time offenders charged with a nonviolent offense of the controlled substance act.
“The court may place a person on probation without verdict if the person pleads nolo contendere or guilty to any nonviolent offense under this act and the person proves he is drug dependent.”The term of probation shall be for a specific time period not to exceed the maximum for the offense upon such reasonable terms and conditions as the court may require.
