DNA in Sexual Assault and Rape Cases

Sex charges such as Sexual Assault and Rape require that the government proves beyond a reasonable doubt that the accused penetrated the alleged victim against her will. Almost all of these types of crimes require that the government tries to locate corroborating evidence that the accused did in fact have some sort of sexual interaction with the alleged victim. In these cases, the government strongly urges the alleged victim to consent to a Rape Kit, so that law enforcement can try and discover the identity of the alleged sexual offender through his or her DNA.

What Is a Rape Kit?

A Rape Kit is a collection of the various evidence found on the alleged victim typically right after the alleged sexual crime occurred. The Rape Kit involves specialized nurses, clipping the finger nails of the alleged victim and swabbing her most intimate areas in an effort to locate various skin fragments, sperm and other evidence which can be tested by a serologist and later by a DNA lab tech in order to see if they can identify who the sperm and other DNA fragments belonged to.
