Intermediate Punishment Program (IPP) is available to those who have been charged with DUI. IPP is a sentencing alternative.  It provides an option for those who have been charged with a DUI a decreased period of incarceration.  In order for a person to receive the benefits of Chester County IPP, he must complete the application (which includes attending alcohol highway safety school, complete a CRN evaluation, and complete a full drug and alcohol assessment), the adult probation office must recommend that the candidate is eligible for IPP, and at sentencing, the judge must impose the IPP sentence.  

IPP is available for DUI offenses and some other non-DUI offenses.  This entry will deal only with the DUI IPP.  The person’s IPP sentence depends on two factors: (1) how many prior offenses the person has and (2) what the person’s B.A.C. was.  See below for the sentencing grid:

DUI (1st offense; BAC .10-.159): NO INCARCERATION; 6 mos. supervised probation; $500.00 fine, NO IGNITION INTERLOCK; 10 days electronic home monitoring; 32 hrs. community service

DUI (1st offense; BAC .16 & Higher): 24 hrs. incarceration; 6 mos. supervised probation; $1,000.00 fine; NO IGNITION INTERLOCK; 20 days EHM; 32 hrs. community service

DUI (2nd offense; BAC .08-.099): 48 hrs. incarceration; 6 mos. supervised probation; $300.00 fine; YES ignition interlock; 45 days EHM; 80 hrs. C/S

DUI (2nd offense; BAC .10-.159): 72 hrs. incarceration; 6 mos. supervised probation; $750.00 fine; YES ignition interlock; 60 days EHM; 80 hrs. C/S

DUI (2nd offense; BAC .16 & Higher): 15 days incarceration; up to 5 years of supervised probation; $1,500.00 fine; YES ignition interlock; 75 days EHM; 80 hrs. C/S

DUI (3rd offense; BAC .08-.099): 5 days incarceration; 2 yrs. supervised probation; $500.00 fine; YES ignition interlock; 75 days EHM; 160 hrs. C/S

DUI (3rd offense; BAC .10-.159): 30 days incarceration; up to 5 yrs. supervised probation; $1,500.00 fine; YES ignition interlock; 90 days EHM; 160 hrs. C/S

DUI (3rd offense; BAC .16 & Higher): 90 days incarceration; 90 days partial confinement consecutive (meaning served after the 90 days of incarceration); up to 5 years supervised probation; $2,500.00 fine; YES ignition interlock; 6 mos. EHM; 240 hrs. C/S
