Pennsylvania Department of Transportation (PennDOT) maintains a driving record for every licensed driver in Pennsylvania. Certain traffic (or moving) violations can add points to a person’s driving record. This blog will deal with the specific consequences when the accumulation of points reaches a given threshold.
For a driver under the age of 18 years:
the driving privilege of a person under the age of 18 will be suspended if that person accumulates 6 or more points. The first suspension will be for 90 days and any subsequent suspension will be for 120 days.
For a driver over the age of 18 years:
For the first accumulation of 6 or more points:
The person will be required to take a special written examination. The person shall have 30 days to pass the exam or else his license shall be suspended until the exam is passed. If the person completes the exam within the 30 day period, 2 points will be removed from his driving record.
For the second accumulation of 6 points:
The driver will receive notice of a PennDOT Hearing where his record will be reviewed. At that time, the person may be subjected to a 15 day license suspension, required to take an on-the-road driver’s exam, or a combination of both. Failure to attend the hearing will result in a 60 day license suspension. if the Department suspends the driver’s license for 15 days, 2 points will be removed from the driving record at the conclusion of the suspension period. Similarly, if the driver is required to complete the driving exam, the person has 30 days to complete the exam and if he does, 2 points will be removed from his record.
For a 3rd accumulation of 6 points:
The driver could be subjected to a 30 day license suspension. Failure to attend the hearing will result in a suspension of the driver’s licenses until the driver attends the hearing.
