The sentencing guidelines are a guide for a judge that he or she must consider when sentencing a defendant. Criminal Defense Investigations The major factors the guidelines consider are does the accused have prior convictions? The general rule is, the more serious the offense (i.e. is the crime a felony, and if it is then how serious a felony is it?), the more time the accused is looking at prison.
