Criminal Defense Disorderly Conduct

Pennsylvania criminal defense law prohibits crimes such as disorderly conduct which criminalizes actions that would annoy, alarm or otherwise disrupt the natural order of everyday life. juvenile sex offenses Shouting obscenities while walking around a park or getting into a shouting match with a driver who cut you off in traffic would be examples of behaviors that might land you in legal trouble due to the unruly nature of the behaviors. In the previously mentioned examples, along with many other behaviors that vary significantly, a charge of disorderly conduct might apply. Disorderly conduct is defined under section 5503of the Pa criminal codes. Essentially an individual is guilty of this offense if they intentionally or recklessly cause a public inconvenience by engaging in fighting or threatening, or in violent or tumultuous behavior, making unreasonable noise, using obscene language, or making an obscene gesture, or creating a hazardous or physically offensive condition by any act which serves no legitimate purpose of the actor.

In terms of criminal defense, Disorderly conduct is another vaguely written statute that can encompass a whole host of behaviors. Because of this, officers responding to various situations have a charge that they can use to maintain order across many different circumstances. criminal mischief It is important to note that while this statute does not prohibit any one specific behavior and instead encompasses what is considered "unruly behavior", not every behavior rises to meet this standard. A charge of disorderly conduct can, however, rise to the level of being a misdemeanor, although it is graded as a summary offense. Instances where a substantial disturbance occurred, or if the individual was previously warned to stop a particular behavior but failed to comply, often rise above the summary grade to a misdemeanor. In those instances, it is even more important to seek good legal representation to minimize the penalties that are imposed. A good defense attorney will look at the circumstances surrounding your case and decided the best course of action to take when fighting a charge of disorderly conduct. The attorneys at the Law Offices of Kelly and Conte are experienced attorneys who will fight to get you the best possible resolution given the facts of your particular case.
